Welcome to puq.ai ("we," "our," or "us"). By accessing or using our website, application, API, and workflow automation services (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Service.
"Service" refers to the puq.ai workflow automation platform, including its AI capabilities and integrations.
"User" or "You" refers to the individual or entity registering for or using the Service.
"Workflow" refers to the automated sequences of actions configured by the User to be executed by the Service.
"Third-Party Services" refers to external applications (e.g., Slack, Gmail, Salesforce) that you connect to puq.ai.
To use the Service, you must register for an account. You agree to:
Provide accurate, current, and complete information during registration.
Maintain the security of your password and API keys.
Accept responsibility for all activities that occur under your account.
Notify us immediately of any unauthorized use of your account.
Crucial for Automation: By connecting Third-Party Services to puq.ai, you explicitly grant us the authority to act as your agent.
You authorize puq.ai to access, read, write, modify, and delete data within your connected Third-Party Service accounts (e.g., sending emails via Gmail, posting messages to Slack) as instructed by your configured Workflows.
You represent and warrant that you have the necessary rights to grant us this access and that your use of the Service does not violate the terms of service of any Third-Party Service.
5.1 No Guarantee of Accuracy The Service utilizes Artificial Intelligence (AI) and Machine Learning (ML) to process data and execute decisions. You acknowledge that AI is probabilistic and may produce errors, hallucinations, or inaccurate outputs. We do not guarantee the accuracy, completeness, or reliability of any AI-generated content or action.
5.2 Automation Liability Waiver You accept full responsibility for all Workflows you create. puq.ai is not liable for:
Unintended deletion, modification, or corruption of data caused by your Workflows.
Emails, messages, or content sent erroneously to third parties via your automated Workflows.
Financial loss or business interruption resulting from an automated action or a failure of an automated action to trigger.
Recommendation: We strongly advise testing all Workflows in a safe environment before deploying them to production or critical systems.
6.1 API Availability Our Service depends on the availability of APIs provided by Third-Party Services (e.g., Google, Slack, X/Twitter). We are not responsible for any interruption to the Service caused by:
Downtime of a Third-Party Service.
Changes to a Third-Party Service’s API or Terms of Service.
Revocation of your access credentials by a Third-Party Service.
6.2 API Limits You agree to adhere to the API rate limits and usage policies of both puq.ai and any connected Third-Party Services. We reserve the right to throttle or suspend Workflows that exceed reasonable usage limits or threaten the stability of our infrastructure.
7.1 Your Data You retain ownership of all data, files, and content you upload or process through the Service ("User Content"). You grant us a limited, worldwide, non-exclusive license to process, store, and display this data solely to provide the Service to you.
7.2 AI Training (Privacy Choice)
We do not use your specific proprietary workflows or private data to train our general public AI models without your explicit consent.
To improve our Service, we may use anonymized and aggregated usage data to train our AI models. We will never use your confidential data or Personally Identifiable Information (PII) for model training.
7.3 Our IP The puq.ai platform, including its code, design, "puq" logo, and proprietary algorithms, is the exclusive property of XON Inc.
You agree not to use the Service to:
Automate the distribution of spam, unsolicited marketing, or harassment.
Bypass or circumvent security measures or API rate limits.
Process illegal content or facilitate illegal activities.
Reverse engineer or attempt to extract the source code of the Service.
Fees: Service is billed on a [Monthly/Annual] basis. All fees are non-refundable except as required by law.
Changes: We reserve the right to change our pricing upon notice to you. Continued use of the Service after a price change constitutes your agreement to pay the changed amount.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PUQ.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
(A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE;
(B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE;
(C) ANY UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
You agree to defend, indemnify, and hold harmless puq.ai and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your Workflows, or your violation of these Terms.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
These Terms shall be governed and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions.
